These Terms of Use ("Terms") govern your access to and use of the website at zexapp.com and any related services (collectively, the "Services") provided by zexapp.com ("we," "us," or "our").

The Services are operated by Dmytro Pestov, a sole trader (enterprise of a foreign person) registered in the Trade Register of the Slovak Republic, District Office Bratislava, No. 110-337548, Company ID (IČO): 56015241, place of business: Obchodná 559/37, 811 06 Bratislava-Staré Mesto, Slovak Republic.

Please read these Terms carefully before using the Services. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

1.2. These Terms apply to all visitors, registered users, and any other persons who access or use the Services.

1.3. By using the Services you confirm that you have read, understood, and agree to these Terms and our Privacy Policy.

2.1. To access certain features of the Services, you must register for an account. You agree to provide accurate, current, and complete information during registration and to keep it up to date.

2.2. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

2.3. Each person may maintain only one account. You must be at least 18 years of age to create an account.

3.1. Property listings displayed on the Services are provided by brokers, real estate agencies, and other third parties. We do not guarantee the accuracy, completeness, or timeliness of any listing information. No agency, partnership, or employment relationship is created between you and us or between you and any listing provider by your use of the Services.

4.1. Price and billing. The Plus subscription is priced at EUR 7 per month. The operator is not a VAT payer; no VAT is charged. The subscription is billed monthly in advance to the payment card you provide via our payment processor, Stripe. It renews automatically each month until cancelled.

4.2. Free trial. A 7-day free trial is available only to accounts that have never had a Plus subscription or trial before. A valid payment card is required to start the trial. The first charge of EUR 7 occurs automatically at the end of the trial period unless you cancel before the trial ends. We will send a reminder email 3 days before the trial expires.

4.3. Cancellation. You may cancel your Plus subscription at any time from your account (Subscription page). Cancellation takes effect at the end of the current paid period. No partial refunds are issued for the remaining portion of the current billing period. You will continue to have access to Plus features until the end of the period you have already paid for.

4.4. Failed payment. If a scheduled payment fails, your access to Plus features may be suspended until the payment is successfully processed.

4.5. Price changes. We may change the subscription price by giving you at least 30 days' prior notice by email. Your continued use of the Plus subscription after the new price takes effect constitutes acceptance of the change.

4.6. Right of withdrawal. By starting the subscription or free trial, you expressly request that the digital service begins immediately and you acknowledge that you thereby lose the 14-day right of withdrawal under EU consumer law (Directive 2011/83/EU) and Slovak Act No. 108/2024 Coll. on consumer protection. You give this consent by accepting these Terms during the Stripe checkout process.

4.7. What Plus includes. The Plus subscription provides access to premium features as described on the Subscription page. The specific features included in Plus may evolve over time; we will notify you of material changes.

5.1. By creating an account, you agree to receive service-related and promotional email communications as described in the "Email communications" section of our Privacy Policy. You may opt out of promotional emails at any time using the unsubscribe link provided in each email.

6.1. The Services and their original content (excluding content provided by users or third-party listing providers), features, and functionality are and will remain the exclusive property of zexapp.com and its licensors. The Services are protected by copyright, trademark, and other laws. Our trademarks and trade dress may not be used without our prior written consent.

6.2. You retain ownership of any content you submit to the Services (e.g., property listings). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute it in connection with operating and promoting the Services.

7.1. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2. To the maximum extent permitted by applicable law, in no event shall zexapp.com be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of the Services.

7.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence. Your mandatory rights as a consumer under applicable EU or national consumer protection legislation remain unaffected.

8.1. We may terminate or suspend your account and access to the Services immediately, without prior notice, if you breach any provision of these Terms.

8.2. You may delete your account at any time by contacting us. Upon termination, your right to use the Services will cease immediately. If you have an active paid subscription, cancellation terms in Section 4.3 apply.

9.1. We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. For changes that materially affect your rights or obligations, we will make reasonable efforts to provide advance notice (e.g., via email or a prominent notice on the Services).

9.2. Your continued use of the Services after any changes to these Terms constitutes your acceptance of the revised Terms.

10.1. These Terms shall be governed by and construed in accordance with the laws of the Slovak Republic, without regard to its conflict-of-law provisions.

10.2. If you are a consumer, you may submit a complaint to a Slovak alternative dispute resolution (ADR) body, such as the Slovak Trade Inspection (Slovenská obchodná inšpekcia, www.soi.sk).

10.3. Any disputes arising out of or in connection with these Terms that cannot be resolved amicably or through ADR shall be submitted to the competent courts of the Slovak Republic.
